Splashie Weekly Golf Tournament
OFFICIAL RULES
- HOW TO ENTER: The Splashie Weekly Golf Tournament (“Tournament”) begins at 12:01 a.m. Pacific Time (“PT”) on the Monday of this calendar week and ends at 11:59 p.m. PT on the Sunday of this same calendar week (“Tournament Period”). To enter the Tournament: By no later than 11:59 p.m. PT on the Sunday night of the Tournament Period (the “Entry Deadline”), (a) visit www.Splashie.com (the “Website”), (b) log-in to Splashie.com using your Facebook account identification, and (c) enter the Tournament by clicking on a entry button hyperlink on the Website and following any on-screen directions on the Website for entry. (You must be a member of Facebook in order to enter the Tournament. There is no charge to become a member of Facebook.) There is a limit of one (1) entry per person and per Facebook account for this Tournament. Attempts to use multiple Facebook accounts, or any other methods, to enter this Tournament more than once will result in disqualification. When entering the Tournament you may be asked to provide information regarding your golf skill level, including but not limited to (i) your average gross golf score for play on an 18 hole course and/or (ii) your USGA handicap number, if you have been assigned one. The information you provide (along with the other criteria described below) will be used to determine the Flight (as defined below) to which you may be assigned for the Tournament. Accordingly, the information you provide must be truthful and accurate. Failure to provide truthful and accurate information regarding your golf skill level will result in disqualification. Except as may be indicated on the Website, Splashie, Inc. (“Tournament Administrator”) will not verify receipt of entries. The Tournament Administrator may reject any entry in its sole discretion.
- ELIGIBILITY: To enter the Tournament you must (a) be an individual who is 18 years of age or older at the time of entry, (b) be a permanent resident of the 50 United States or the District of Columbia who is actually residing in, and physically present in, such geographic area, (c) be a Facebook member, and (d) not be a current or former member of the Professional Golfers’ Association of America (“PGA”) (other than a PGA Teaching Professional [as defined below]) or the Ladies Professional Golf Association (“LPGA”). Provided that they meet the other eligibility requirements of these Official Rules, PGA Teaching Professionals are eligible to enter the Tournament. A “PGA Teaching Professional” is defined as a teaching professional certified by the PGA who has not competed in a PGA professional tour, or won more than $50,000.00, within the year preceding such person’s entry in this Tournament. The Tournament Administrator may require any entrant in the Tournament to sign and return an affidavit of eligibility at any time. This Tournament is not offered to anyone who does not meet the eligibility requirements stated above and is void outside of the geographic area described above, and where restricted or prohibited by law. Employees of the Tournament Administrator and any sponsors of the Tournament (“Sponsors”), and their respective affiliated companies (parents and subsidiaries), and the advertising and promotion agencies of each (collectively, the “Tournament Entities”), and members of the immediate families (parents, children, siblings and spouse, regardless of where they reside) and households (whether related or not) of such employees, are not eligible to participate in this Tournament.
- FLIGHT ASSIGNMENTS:
- The Tournament Administrator may assign each eligible entrant to a group of entrants with generally similar golf skills (each group a “Flight”). If such assignment is made it will be based on (a) the skill level of the entrant, (b) the skill level of other entrants, (c) the total number of entrants in the Tournament and (d) such other factors as the Tournament Administrator may utilize in its sole discretion. In making such assignment, the Tournament Administrator may establish each entrant’s golf skill level by factoring in (i) any self reported assessment of skills submitted by the entrant, (ii) golf scores reported for the entrant, (iii) Splashie Scores (as defined below) previously reported for the entrant, and iv) such other factors as Tournament Administrator may utilize in its sole discretion. The Tournament Administrator may also apply a proprietary algorithm both to assign Flights and to determine if an entrant has engaged in Sandbagging. If utilized, flights will be constructed in order to be fair, competitive and inclusive.
- The decision of whether to assign Flights, and the methods and decisions employed in establishing Flight qualifications and making any Flight assignments, shall be made at the sole discretion of the Tournament Administrator. Accordingly, entrant agrees not to dispute any Flight assignment pertaining to the entrant or to any other entrant. Notwithstanding the initial assignment to a given Flight, in order to insure a fair and competitive Tournament, the Tournament Administrator may rearrange the composition of Flights or reassign any entrant to a different Flight at any time during the Tournament, in its sole discretion. Flight assignments are specific to this Tournament only and may vary in future tournaments. Therefore, it is possible that you may be assigned to a different Flight in this Tournament than in a previous tournament, or you may be assigned to a different Flight in a future tournament.
- “Sandbagging” is defined as any attempt by an entrant, either alone or in concert with others, to mislead the Tournament Administrator as to his/her true golf skill ability level. The determination of whether an entrant has engaged in Sandbagging shall be made by the Tournament Administrator in its sole discretion. In the event the Tournament Administrator determines that an entrant has engaged in Sandbagging, or in any other fraudulent or unethical conduct, then such entrant, and any other entrant who acted in concert with such person, shall be disqualified.
- HOW TO COMPETE IN THE TOURNAMENT: To compete in the Tournament simply:
- Enter the Tournament in the manner described above by the Entry Deadline.
- Play one (1) round of golf on any 18 hole golf course (or two [2] rounds of golf on a regulation 9 hole golf course) you choose located within the 50 United States or the District of Columbia during the Tournament Period. Make a note of the number of eagles, birdies, pars, bogeys, double bogeys and triple bogeys or greater (“Shots”) that you made during the round(s) of golf you played. Partial or incomplete games of golf are not eligible, and neither are rounds of golf played on non-regulation 9 hole golf courses, or par 3 courses, or executive courses.
- All rounds must be played from the tees that are the next to farthest from the green (often referred to as the “blue tees”), regardless of the gender, age or skill level of the entrant. You may play from the championship tees but this may impact your Splashie Scores and your standing in the Tournament.
- After play, by no later than 11:59 p.m. PT of the Sunday night during the Tournament Period (the “Score Deadline”), return to the Website, log-in and input the types and number of Shots that you made into the Splashie score calculator in accordance with the directions on the Website. The Splashie Score calculator will then generate a score (“Splashie Score”) for that round of golf using Splashie.com’s proprietary scoring system that measures the ability and consistency of a golfer and takes golf course difficulty into account. The higher the Splashie Score the better the golfer and the higher his/her ranking will be in the Tournament. All Splashie Scores are subject to verification and validation by the Tournament Administrator.
- If you fail to properly input your Shots on the Website by the Score Deadline, then you will be disqualified from the Tournament. Valid Splashie Scores of eligible entrants that have been properly inputed on the Website by the Score Deadline are eligible to compete in and be ranked in the Tournament (unless rejected or altered by the Tournament Administrator). In order to insure a fair and competitive Tournament, the Tournament Administrator reserves the right to reject or alter any Splashie Score at any time in its sole discretion.
- GOLF RULES: The United States Golf Association (“USGA”) rules of golf apply to all play except where such rules are in conflict with the Official Rules of this Tournament. In the event of such conflict, the Official Rules of this Tournament shall prevail. All rounds must be played from the tees that are the next to farthest from the green (often referred to as the “blue tees”), regardless of the gender, age or skill level of the entrant. Entrants may play from the championship tees but this may impact their Splashie Scores and standing in this Tournament.
- SELECTION OF TOURNAMENT PRIZE WINNERS: After the Score Deadline for the Tournament, the Tournament Administrator will rank eligible entrants (including within each Flight if Flights are used) based on their Splashie Score, with the entrant receiving the highest Splashie Score being ranked first and all other eligible entrants ranked thereafter in descending order of their Splashie Score. Thereafter, upon review and confirmation of the rankings by the Tournament Administrator, and verification of the eligibility of any potential winners, the Tournament Administrator will select the prize winner(s) in the Tournament (including prize winners within ach Flight if Flights are utilized) by awarding the top prize to the highest ranked eligible entrant in the Tournament (or within each Flight if Flights are used) and awarding any remaining prizes to the next highest ranked eligible entrants, as applicable. In the event of a tie, the eligible entrant with the highest Splashie Score (without any limit to the number of decimal places used) will be ranked higher. In the event there is still a tie, then the eligible entrant who played on the more difficult golf course (as determined by the Tournament Administrator in its sole discretion) will be ranked higher. In the event there is still a tie, then the entrant with the highest average Splashie Score reported in prior Splashie tournaments will be ranked higher. In the event there is still a tie, then the entrant with the most birdies reported in the Tournament will be ranked higher. In the event there is still a tie, then the entrant with the most pars reported in the Tournament will be ranked higher. In the event there is still a tie, then the entrant with the most single bogeys reported in the Tournament will be ranked higher. During the calendar week following the Tournament, the Tournament Administrator will post the standings for this Tournament on the Website. Such standings are subject to adjustment at any time at Tournament Administrator’s sole discretion
- PURSES/PRIZES: The total purse (“Purse”) and/or individual prizes, whether physical or virtual, (collectively, the “Prizes”) for the Tournament and for each Flight therein (if applicable) are established by the Tournament Administrator in its sole discretion. A description of any such Purse and/or Prizes, as well as the number of Prizes to be awarded in the Tournament and each Flight (if applicable), shall be posted on the Website during the Tournament Period. The Tournament Administrator shall not be liable for any typographical error, mistake, or fraudulent or intentional misconduct by entrants or other parties not affiliated with the Tournament Administrator, with respect to the number or value of Prizes or Purses posted on the Website. Odds of winning a Prize depend on the number of eligible entries received, the skill of each entrant and other entrants in the Tournament, and the number of Prizes to be awarded.
- AMATEUR STATUS: Entrants may opt to keep their amateur status by notifying the Tournament Administrator, in writing, that they are refusing to accept any prize money. In that instance the Prize for such entrant will be forfeited by the entrant and that Prize will not be awarded in the Tournament.
- GENERAL PRIZE RESTRICTIONS/CONDITIONS: There is a limit of one Prize per person for this Tournament. Each potential winner may be required to execute and return an Affidavit of Eligibility, which includes a Liability Release and a Publicity Release (except where prohibited) (collectively, “Affidavit/Release”). The Affidavit/Release must be returned by the deadline established in such document(s). If a potential winner fails to return such document(s) within that time, or if the Tournament Administrator determines, in it sole discretion, that an entrant is ineligible, or an entrant has not complied with the Official Rules, or has committed fraud, or engaged in Sandbagging, cheating, or the direct or indirect falsification of any scores, or any other dishonest conduct during the Tournament, then the entrant or potential winner (as appropriate) may be disqualified and, in the case of the potential winner, an alternate winner may be selected using the criteria established in these Official Rules. If Prizes or Prize notifications are returned as undeliverable, this may result in disqualification and an alternate winner may be selected using the criteria established in these Official Rules. All federal, state, local and other tax liabilities, including but not limited to income and withholding taxes, in connection with a winner’s award, acceptance or use of a Prize arising from this Tournament will be the sole responsibility of each winner. Except where prohibited by law, each entrant’s entry, and each winner’s acceptance of a Prize, constitutes permission by the entrant for the Tournament Entities to use said entrant’s name, Splashie Scores, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, for any and all purposes, without further compensation or notice.
- TOURNAMENT CONDITIONS: By participating, entrants agree to be bound by these Official Rules and the decisions of the Tournament Administrator, and waive any right to claim ambiguity in the Tournament or these Official Rules. Although these Official Rules may be available in multiple languages, the English language version of these Official Rules shall prevail in the event of any conflict or difference between the English language version and any version in another language. Playing golf always involves certain inherent risks of personal injury and damage to property, including but not limited to risks associated with weather, golf carts, errant golf balls and golf clubs, and wildlife. Each entrant and winner, individually and on behalf of his/her heirs, accordingly agrees to assume any and all risks involved with the play of golf connected to the Tournament and to release, discharge, indemnify and hold harmless the Tournament Entities and Facebook, and each of their respective officers, directors, employees, representatives and agents, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind (collectively, “Claims”) resulting in whole or in part, directly or indirectly, from (a) acceptance, possession, misuse or use of any Prize, (b) participation in any Tournament-related activity or participation in this Tournament, (c) any malfunction of the Website, (d) any error in the collection, verification or retention of entry information or Splashie Scores, or (e) any use of an entrant’s entry, name, Splashie Scores, photograph, likeness, statements, biographical information, voice, or city and state address. Accordingly, the Tournament Entities and Facebook will have no liability whatsoever to entrant or his/her heirs for Claims relating to items (a) through (e) above.
- LIMITATIONS OF LIABILITY: The Tournament Entities are not responsible for system errors, delays or failures, faulty transmissions or other telecommunications malfunctions, any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, typographical or system errors or failures, unauthorized access to the Website, failure of any cable or DSL connectivity or computer servers, or traffic congestion on the internet, or any damage to a entrant’s computer as a result of visiting or logging in to Splashie.com or participation in the Tournament, or for any other problems or technical malfunctions. The Tournament Entities are also not responsible for any malfunction of the Website or error in the collection, processing or retention of log-in information, entry information, scores or rankings. The Tournament Administrator may prohibit a entrant from participating in the Tournament or winning a Prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Tournament by cheating, Sandbagging, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or the Tournament Administrator’s representatives. In the event of insufficient participation in all or part of the Tournament (as determined by the Tournament Administrator in its sole discretion), Tournament Administrator reserves the right, at its sole discretion and without advance notice, to a) cancel and terminate all or part of the Tournament (including any Flights[s] therein), and/or b) extend any deadlines, time periods and event dates specified herein, and/or c) alter the number or value of any Prizes offered. In the event all or part of the Tournament (including any Flight[s] therein) is cancelled or terminated, no Purses or Prizes will be awarded with respect thereto. If for any reason this Tournament is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of the Tournament Administrator which corrupt in any way or affect the administration, security, fairness, integrity, fulfillment or proper conduct of the Tournament, then the Tournament Administrator reserves the right, at its sole discretion and without advance notice, to cancel, terminate, modify or suspend the Tournament and select winners by applying such criteria as is established by the Tournament Administrator at the time of the cancellation/termination/suspension date. CAUTION: ANY ATTEMPT BY A ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE TOURNAMENT MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE TOURNAMENT ADMINISTRATOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
- DISPUTES: By participating in this Tournament, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Tournament or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Federal or state courts located in Los Angeles, California; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Tournament, but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, and any and all rights to have damages multiplied or otherwise increased, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Tournament Administrator in connection with the Tournament, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California
- PRIVACY: All information submitted as part of this Tournament will be treated in accordance with the Tournament Administrator’s privacy policy, available at http://www.splashie.com.
